What to Do If You’re Stopped With Legal Cannabis

It wasn’t too long ago that getting caught with marijuana was a pretty bad offense. Although cannabis is slowly becoming legal in various states, it’s still outlawed at the national level. So, depending on where you are, you might have to be extra careful when transporting your weed.

That said, even if you’re in a state where it’s legal, you might have to take various precautions. As with anything else, it’s always best to know what to expect beforehand. This way, you’re prepared if or when the worst happens. So, with that in mind, let’s look at what to do if you’re stopped with legal cannabis.

Step One: Know Your State’s Cannabis Laws

If you’re a cannabis enthusiast, you’re likely familiar with the substance’s legality within your state already. However, since these laws are constantly changing and getting updated, it’s good to get a refresher. As of April 2022, marijuana is legal in some form in 37 states. The places where it is ,entirely legal (not just for medicinal purposes) include:

  • Washington
  • Oregon
  • California
  • Nevada
  • Arizona
  • Montana
  • Colorado
  • South Dakota
  • Michigan
  • Illinois
  • Alaska
  • Virginia
  • New Jersey
  • New York
  • Massachusetts
  • Maine
  • Vermont
  • Washington, D.C.

Only Nebraska has outlawed cannabis of all kinds (including CBD), so unless you’re driving there, you should have some wiggle room.

Step Two: Be Honest, But Not Necessarily Open

If you’re driving in a cannabis-legal state, you shouldn’t feel too worried about what might happen during a routine stop. However, just because it’s legal doesn’t mean you should be forthcoming about your habits. For example, if you say you’ve smoked already during the day, you might have to submit to a sobriety test. That said, if an officer asks you a direct question, you should answer it truthfully.

Step Three: Never Smoke and Drive

Because marijuana can impair your judgment and driving abilities, you should never smoke or ingest it before getting into a vehicle. You never want to put yourself in a situation where you could get hauled to jail and have your license suspended or revoked because of being irresponsible or negligent. It’s not worth the temporary high.
